The Ministry of Corporate Affairs had mandated updating the Director Identification Number (DIN), by providing Passport, Aadhar card copy, followed by mobile OTP verification and email OTP verification. A form called DIR 3 KYC had to be filed with the Ministry for updating the DIN KYC on or before September 15th 2018. Delay in filing DIR 3 resulted in penalty of Rs. 5,000.
Out of 33 lakh active director who had to file DIR 3 by that date, 12.16 lakh DIR 3 forms were filed. This has now prompted the government to extend the date for filing to 5 October 2018 with reduced penalty of Rs. 500.
This extension has brought much needed relief to all concerned. C S Lele, President, Institute of Company Secretaries of India (ICSI) said “We are hopeful that this further extension would provide much needed relief to the stakeholders. The stakeholders are advised to utilise the extended time for filing the said form”
Non-filing of DIR 3 by this date shall result in the following consequences
- The DIN shall be deactivated and the directors would not be able to file the annual returns of their companies with the Registrar of Companies.
- Till the DIN is activated, the director would not be able to take position on the Board of any other company and further, would not be able to set up a new company as its first director
- Activation of DIN shall be on the payment of Rs. 5,000
